Right of Withdrawal

If you are a consumer, you generally have the right to withdraw from this contract within fourteen days without giving any reason. For contracts concerning the delivery of goods, the withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, takes possession of the goods.

Where several goods ordered as part of one order are delivered separately, the withdrawal period begins when you, or a third party designated by you who is not the carrier, takes possession of the last item.

of your decision to withdraw from the contract by means of a clear statement.

You may use the Model Withdrawal Form provided by us, but use of that form is not mandatory. Where an electronic withdrawal function is provided through our online interface, you may also exercise your right of withdrawal through that function. To meet the withdrawal deadline, it is sufficient for you to send your notice of withdrawal before the withdrawal period has expired.

Effects of Withdrawal

If you withdraw from the contract, we will reimburse all payments received from you, including the cost of the least expensive standard delivery method offered by us.

Additional delivery costs resulting from your choice of a delivery method other than the least expensive standard delivery offered by us will not be reimbursed. Reimbursement will be made without undue delay and no later than fourteen days after the day on which we receive your notice of withdrawal. Unless expressly agreed otherwise, we will use the same payment method for the reimbursement that you used for the original transaction.

For contracts for the sale of goods, we may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever occurs first. You must return or hand over the goods without undue delay and in any event no later than fourteen days from the day on which you inform us of your withdrawal. The deadline is met if you dispatch the goods before the fourteen-day return period has expired. You bear the direct cost of returning the goods unless DS V-LINE has expressly agreed to bear those costs or provides you with a prepaid return label.

You are liable for any diminished value of the goods only where that diminished value results from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Exceptions and Early Expiry of the Right of Withdrawal

The right of withdrawal does not apply, among other statutory exceptions, to sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

For digital content not supplied on a tangible medium, the right of withdrawal may expire once performance begins if you have expressly agreed that DS V-LINE may begin performance before the withdrawal period has expired, you have acknowledged that you will lose your right of withdrawal once performance begins, and the other statutory requirements have been met. For services that have been fully performed, the right of withdrawal may expire where the statutory conditions are satisfied. Your mandatory statutory rights remain unaffected.
